1. Acceptance of Terms

By using Labs Tracker ("the app"), you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Description of Service

Labs Tracker is a personal health tracking tool that allows you to:

Upload lab result PDFs for automatic data extraction
Manually enter lab results
Track biomarker trends over time
Store your health data securely in the cloud

3. Personal Use Tool Disclaimer

Important: Labs Tracker is a personal health tracking tool for individual, non-commercial use only. This app is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare provider for medical advice.

We do not:

Provide medical advice or diagnoses
Replace professional healthcare
Guarantee the accuracy of extracted data from PDFs
Make health recommendations based on your data
Operate as a healthcare provider or covered entity under HIPAA

This tool is designed to help you personally organize and visualize your own lab results. You are responsible for the accuracy and security of any health information you choose to upload.

3a. HIPAA Non-Applicability & Health Data

HIPAA Notice: Labs Tracker is NOT a covered entity, business associate, or subcontractor under the Health Insurance Portability and Accountability Act (HIPAA). This service is NOT HIPAA-compliant and does NOT provide the safeguards required for Protected Health Information (PHI).

By creating an account and using this service, you acknowledge and agree that:

You are uploading your own personal health data for your own personal use
You are not uploading health data on behalf of patients, clients, or any third party
You are not using this service as part of any healthcare treatment, payment, or operations workflow
The data you upload is treated as personal information, not as Protected Health Information (PHI) under HIPAA
While we use commercially reasonable security measures (encryption in transit and at rest, access controls, and secure hosting), we do not claim compliance with HIPAA, HITECH, or any healthcare-specific security standard
You assume all risk associated with uploading health-related data to this platform

If you are a healthcare provider, employer, health plan, or any entity subject to HIPAA, you may not use this service to store, process, or transmit Protected Health Information.

3b. Assumption of Risk

You acknowledge that no method of electronic storage or transmission over the internet is 100% secure. While we strive to use commercially reasonable means to protect your personal data, we cannot guarantee its absolute security. You use this service at your own risk and voluntarily choose to upload any health-related data.

3c. Indemnification

You agree to indemnify, defend, and hold harmless Labs Tracker, its operators, affiliates, and service providers from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the service
Your violation of these Terms
Your upload of health data or any other content
Any claim that your use of the service violates any applicable law or regulation, including but not limited to HIPAA

4. User Responsibilities

You agree to:

Provide accurate information when creating an account
Keep your login credentials secure
Use the app only for lawful, personal purposes
Not upload content that violates others' rights
Verify extracted data against your original lab reports

5. Account & Data

You are responsible for:

Maintaining the confidentiality of your account
All activities under your account
Keeping backups of your important health records

We reserve the right to suspend accounts that violate these terms.

6. Intellectual Property

The app's code, design, and branding are owned by Labs Tracker. Your data remains yours - we claim no ownership over your health information.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may:

Perform maintenance that temporarily affects access
Modify or discontinue features with reasonable notice
Terminate the service with 30 days notice

8. Limitation of Liability

To the maximum extent permitted by law:

The app is provided "as is" without warranties
We are not liable for any damages arising from use of the app
We are not responsible for decisions made based on app data
Our total liability is limited to the amount you paid (if any)

9. Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we collect and use your data.

10. Changes to Terms

We may update these terms from time to time. Continued use after changes constitutes acceptance of the new terms. We will notify you of significant changes.

11. Termination

You may stop using the app at any time. You can request deletion of your account and all associated data by contacting us.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.
